Topic Subject : Final ISP Infrigement Notice Sent


Dear ALI Members,

On Monday we sent our association's formal complaint to the ISP that hosts http://www.bodyartplace.com (www.justhost.com) over its customer's copyright infringements to which the site used a number of our members' photos and text.

In response to our letter, the ISP requested that we allow them 48-hours in order for them to notify its customer of the copyright infringements and give its customer time to act.

We have waited the allotted time and this morning we sent Ms. Vicky Kemp of Just Host the second notice as she requested in her earlier response to the ALI complaint.

For member information: Under the US Digital Millennium Copyright Act (1998) and the European E-Commerce Directive (2000) online intermediaries (ISPs) who host content that infringes copyright are not liable, so long as they do not know about it and take actions once the infringing content is brought to their attention.

Now that we have given the ISP TWO notices it must act to limit their own liability to further infringement risk.

I shall keep the membership posted.
